Arkansas takes preliminary notice very seriously. In order to file a mechanics lien on an Arkansas residential construction project, a claimant hired by the property owner must generally send a Pre-Construction Notice to owner before work begins. If that notice is not sent, a claimant typically cannot file a valid and enforceable mechanics lien. Plus, their other potential options for recovery (like a lawsuit based on the contract) may be limited, too, under § 18-44-115 of the Arkansas mechanics lien statute. Further, a contractor may even be fined as a result of not sending notice. Ultimately, I'm not sure what the best route of recovery would be when notice has not been sent.
