Lien against my home

I had contractor install granite. I had paid in full. Now the installer sent fedex claims a lien in 15 days for nonpayment from the contractor. Shouldn’t he be taking the contractor to court. I live in Galveston county in Texas. What are my options?

Unfortunately, this is a pretty common fact scenario. Owner pays contractor, contractor doesn't pay sub, sub places lien on the home. It is very possible that the subcontractor has a valid lien on your home. This leaves you as an owner potentially liable for payment to the subcontractor depending on several factors. Your options are to negotiate a payment to remove the lien with the subcontractor, or if the lien is invalid, sue to remove it directly. Additionally, you may sue the general contractor to recoup the money it did not pay to the subcontractor. Whatever option you choose, I suggest retaiingn an attorney quickdly to assit you through this process and help you further determine your options.
