Lien?

New YorkMechanics Lien

My dad got into an argument with a contractor that orchard a peeved of land across the street from his house. The contractor was doing constructing without permits and leaving trash and debris all over the place, creating an eyesore, safety issues, parking difficulty etc. My dad reported the construction without permits and the police and other authorities shut the site down. The next day my dad got a one page typed notice of mechanics lien from this contractor claiming tortuous interference causing damages of 300k. I doubt it's real, it sounds like BS to me and paper terrorism (found that term online). I would think this prices to file a mechanics lien on my dad's house is more difficult than some stranger putting a note in his mailbox over being pissed my dad had him shut down for building without permits.

You cannot lien for tortious interference with contract, if you do, then you will likely be subject to serious penalties. If the contractor actually filed this lien, he could have potentially subjected his contracting entity and himself, individually, to liability up to $300,000.00 (presumably the entire lien would be exaggerated). If this contractor filed this lien, it was a very bad mistake, your first course of action should be to check the County Clerk's Office to see whether the lien was actually filed, if it was, this contractor could be in serious trouble. You could easily have a claim here for up to $300,000.00. If this lien was never actually filed, probably not worth your time, good luck.
