Lender Added to Prelien Information

California

The GC provided preliminary information and confirmed that a Lender was in its final agreements and is going to be added. Do we file prelien with information received or wait till they send updated information with Lender? What is the revision process for added information?

If you are starting work, definitely serve the preliminary notice even if the lender has yet to record a construction trust deed. Lenders generally (try to) verify that no work has commenced before recording its construction trust deed because it otherwise may lose priority. You can serve an amended preliminary notice once the construction lender records a trust deed. You should verify whether the lender exists as of the first day you furnish labor or materials.
