I've been taken advantage of by a general contractor big time. I need to be compensated

Washington

Roman Pools and Spas hired me as an unlicensed contractor knowing I did not have a license. Not knowing the legalities of Washington state I figured I could earn and save the money needed to get licensed. Well it didn't work out that way. I spent 4-5 maybe even 6 months straight without the ability to make money else where and without the ability to control my work thereby not aloud to manage the funds available to even deliver a quality product. The only money I received was not even enough to cover the cost of fuel to get there. I had to come out of pocket and burned up my tools without them being replaced to complete the job. Without the money to get my bond and insurance I hand felt no point in even starting the licensing process which left me ignorant to my rights and lack of legal protection. The only compensation i had hope of was the promise of a long profitable business relationship with Roman Pools and Spas on jobs to come if i just got Tony (the owner of Roman Pool and Spas) through the initial job. From what I've learned I am screwed as far as getting paid though mechanics lien. I also have learned that per the characteristics of work relationship e.g.. not being allowed to control my work defines me as in the eyes of the state as an employee that hasn't been paid . How do I pursue legal action to be compensated for all of my time?

As an unlicensed contractor, you do not have the right to sue for compensation.  You must be licensed to have a cause of action or lien.

By definition set by washington state the relationship between myself and the GC consisted of the elements that describe me as an employee. The question is how does an unpaid employee take legal action against the G C for not paying me for my time and material handling?

Contact L&I. They can collect wages for you.

This is an employment situation in which you were hired as an employee rather than an independent contractor.  Contact the Washington State Dept of Labor and Industries in Olympia for their assistance.
