Its been 86 days since I havent been paid on a job. SHould I file a notice of intent or just file a lein.

I'm a Florida roofing contractor who finished and invoiced a job 86 days ago. Should i file a notice of intent or would it be better to file a lien instead?

I am assuming that your contract was directly with the owner. You have 90 days from finishing your contract work, not including punch-out or trivial work, to file a lien. That time period cannot be extended. If not filed timely you have no lien rights. You must deliver a copy to the owner within 15 days from filing the lien. The copy does not have to be a copy of the recorded lien.

Lien now. You have 90 days from your last day of work to record a claim of lien. Call a lawyer to be sure it’s done right and timely.
