Is there a time limit to file the lien after the intent letter has been sent?

We just sent an INTent to Lien letter. If we don’t receive payment, how long before we can file the lien?

What was your role on the project? Is this a notice to an owner for materials or lease equipment? How much was the project for?

We were the buyers of the house. The house had some fire damage and had 200k insurance claim to remodel from studs in. We picked out everything. We had 4 closing dates. The contractor just quit working on the house and just assumed we’d close. We and the title co, lawyer knew we’d never see the contractor again if we closed. It was a cash sale and between the inspection report and the punch list there was 67+ items not completed. We bought several items for the house: Quartz kitchen sink, all interior and exterior door handles, ceiling lights, it was a total of $1100.00

How long ago did he quit working on the project?

We didn’t close on the house May 3rd. He quit working about 10 days prior to closing.

There are many hurdles to the contractor filing a lien. Since the project was over $100,000, he would have needed a preliminary notice. There are lots of other pitfalls, but I think your best course of action is to sue him if he was paid. If he wasn’t paid, send a clear letter outlining the issues and requesting that he fix the issues.
