Is the lien valid if there was no work done on the property?

CaliforniaConstruction Contract

Is the Mechanical Lien valid if they never did the work. I cancelled the project mid course because of poor communication on their part and negative feedback from my neighbors. I was being bullied into paying them $21,800 for cancelling outside of the 4days cancellation period.

No. In California, a mechanics lien may only be recorded for labor, equipment, or materials used to improve the property. If not work was done on the property, while there may be contractual claims, any amounts owed would not be eligible for a mechanics lien.

Thanks for the clarity Peter. Do you practice lien release? Or can you recommend someone?
