In the state of Alabama, an action to enforce a mechanics lien must be initiated within 6 months of the date in which the debt becomes due. This date has been defined as the date on which the lien claimant last provided labor or materials to the project. Accordingly, if the work was last performed in February, a lien enforcement action must be initiated by August of the corresponding date. If this deadline is missed, the lien claim will expire and no longer be enforceable. At this point, it's time to look to other options for recovery. This can include things such as sending demand letters threatening litigation, using a collection service or even filing a lawsuit for breach of contract in small claims court. Good luck!
