Is retainage returned after completion of a subcontract, or until all prime contract work is completed.

TexasRetainage

I am a subcontractor who has completed my portion of work on a project for a large GC. The GC's project will continue for months. Must I wait until the entire project is completed to request retainage be paid, or is it 30 days after completion of my subcontract requirements?

Hello, Your retainage should be paid within 30 days after the final walk of your subcontract requirements. Under Chapter 53.101 of the Texas Property Code, retainage should only be held during the progress of work under an original contract and for 30 days after the work is completed. You can file a lien for retainage and the deadlines are VERY tight. Tighter than for a regular M&M lien. E. Aaron Cartwright III 214-789-1354 Aaron@EACLawyer.com
