Started job first of January. At beginning of March we pull off to wait for construction so we can do trim out to complete the job. But covid shuts site down. During shut down customer ends up filing chapter 11 in oct. after many requests to get paid I file a lien in Sept before chapter 11. Does that mean because my last day onsite was March 10 my lien is no good even though I never completed work becaise site was shut down ?
Based on your description it sounds like you are too late to file your lien. You have 90 days from last performing services in which to file a lien. The fact that there is an intervening bankruptcy further complicates your claim. You should speak to an attorney who specializes in representing creditors in bankruptcy cases.
