Is my lien enforceable?

ArizonaMechanics Lien

I have a mechanics lien on a residential property in AZ. The home owner has told me that he no longer owes me because he filed bankruptcy. I have never gotten any notice from the courts saying my contract was part of a bankruptcy proceeding and that it is no longer enforceable. Could it be true? Or is he lying, or trying to get me to let my lien expire so he won't have to pay?

Yes he could be lying, yes you are required to get notice and yes it is suspicious if you have not received notice. Ask him for his case number or to send you a copy of his filed bankruptcy petition and see what happens. If he is in fact in bankruptcy, you will need to consult a lawyer because what happens to the lien depends on a number of factors (timing, the kind of property etc.). If you need further assistance, you can contact me at jab@jhc.law or 602-234-7849
