Is it too late to file this lien based on when I sent the intent to lien?

A Colorado Notice of Intent to Lien (NOI) must be sent (along with a copy of the lien to be filed) at least 10 days before filing. Now, as far as the deadline to file the Colorado mechanics lien claim itself, this must be filed within 4 months after the last delivery of services or materials to the project. However, if you only provided labor and no materials to the project, this deadline is shortened to 2 months instead of four. Therefore, as long as the claimant waits 10 days after sending a Notice of Intent, and still files the lien claim before the 4/2 month deadline (whichever is applicable) than a valid lien may still be filed.
