Is it too late to file a mechanics lien on 2 properties in Alabama, that we installed new HVAC equipment for, if we installed on December 7 & 8th 2020? Both properties belong to the same person, and the agreement was for the lady to pay in full, same as cash, within 90 days, and if she failed to do so, the contract was to revert to a 36 month rent to own contract, at 10% interest, beginning 3 months after the date of installation. She only paid the first months debt, and has since not paid a dime, nor can we get her to respond to any types of correspondence. It also stated in the contract that we could "repossess" the equipment, if she doesn't pay. One of the properties are a rental home, and the other, is her primary home.
You are likely too late to file a lien. You can certainly proceed with a breach of contract claim and eventually execute a judgment if she fails to pay.
