Is it possible for a Notice of Completion to be recorded if, us the subcontractor, is still on the job site?

Hello, We received a Notice of Completion for one of our projects (19-0064 Regal Theatre based in 6150 Laurel Canyon Blvd Suite 200 , North Hollywood, CA 91606) I know our lien rights would be shortened to 30 days from when the Notice of Completion was recorded, which our lien rights would expire after today but how is it possible for a NOC to be filed if we are currently still on the job site working on the original scope of work? Would we have any rights against this NOC due to us still working at this job site?

Hi Stephanie,

Many NOCs are prematurely recorded -- that may be what has happened here. From a claimant's perspective, however, it is never safe to assume that this is the case and a claimant would be wise to seek legal counsel to review all of the facts to determine what your next course of action should be (including a mechanics lien).

It sounds like the NOC was filed prematurely. If so, it’s invalid. However, punch list work doesn’t extend the time for you here, it would have to be contract work. Just to be safe you may want to record your lien within 30 days of the NOC recording date, I’m happy to answer any questions you have about this.
