The homeowner we have filed a lien against, and are waiting the 60 days for any contesting, has recorded a new Notice of Commencement for a new roof. My question is, is he allowed to do this AND does it affect our lien.

I don't understand what you mean by "waiting the 60 days for any contesting..." Have you been sent a notice of contest of the lien? If yes, you have 60 days to file suit foreclosing the lien or it expires and cannot be refiled.
