One of my subcontractors filed a preliminary lien against one of my client's property today (8.31.2021). The last time this contractor was on any one of my job sites was well beyond the 20 day deadline. That is to say, more than 20 days ago. Is this preliminary lien invalid?
It sounds like your sub served a late preliminary notice -- with no labor or materials furnished in the 20 day period prior to when the notice was served. In this case, the preliminary notice will likely not preserve lien rights for the subcontractor.
