I’m not being paid on work that I’ve done on a residential roofing project.

As a production manager on a 1099 pay, can I file a mechanics lien in MN?

If you are working directly for the owner and file the lien within 120 days yes. If not direct to owner of roof than you would have needed to mail or deliver a pre-lien to the owner showing you are going to be working on the roof. You can always sue the owner even without a lien if your contract was with the owner and not someone else.

Hello - More details are needed to address your question. What exactly was your role on the project, and what did you provide?

I’m a production manager/sales rep for a residential roofing contractor. I would run the numbers to make sure jobs are profitable, figure out labor bills, material list, schedule the crews and do final inspections of the roof when they’re complete.

Did you perform this work in your individual capacity or on behalf of a company? If the former, did you have a written contract with the owner?

I did it for the company. And no we did not have any type of written contracts. I do not have an LLC or any insurance set up either.

If you performed the service on behalf of a company, you would not have the right to file a lien in your individual capacity. That lien right, if any, would rest exclusively with the company.
