I'm a home owner and hired a contractor to do a job. This project should have taken 2-4 weeks at most. The first day of work was 10-22-19. As of today, about 50% of the project is still incomplete. The proposal quoted was $7000. We have paid $5500 and have been provided with no records of purchases for materials and told they, the contractor don't have to provide. We threatened to fire the contractor and he threatened to file an NTO against us. What can the contractor possibly file against us if anything and how likely would it hold up in court?

The contractor has a time limit to serve a Notice to Owner, but if s/he was directly hired by you, s/he doesn't have to serve you with one since the transaction itself serves as your notice. Going off the limited information provided, the contractor can likely file a lien against your property assuming you hired him or her directly. That doesn't mean it is an accurate lien or that you can't fight it. It is difficult to advise any further with more details, reviewing your contract, etc.

So here are more details. The job was to start on 10-22. I have a collection of texts showing what we we told by the contractor, when they were going to be on site and that they had all materials to finish. One text chain asked on 11/21..” do you have all the materials needed to complete this project”? Answer from contractor..”yes”. Sod was not ordered until Feb. Screen doors not on site until 3-27 and only 1 or the 2 installed. Fence that was allegedly ordered and here back in Nov, Dec still not on site at project location. Slab work done inadequately and not yet finished as of today. Screen panels not installed as of today. So how could all materials have been in and ready on 11/21 if still not done as of 3/28? Contractor has lied on numerous occasions as to having people coming only to have no one show up. The proposal was for $7000 which we have paid $5500 of.
