If we are in contract with the owner (home owner) do we have to have a preliminary notice in place to file a mech lien?

We have been working with a client for roughly 7 years. He has gone silent and not paid us since Sept 2020. Most recent invoices are from Nov. A prelim was never sent originally. He has not responded to threats of a mechanic's lien. Now I want to file one.
