The amount you can recover and the party you can recover from depend upon the terms of your contract. You may also be able to recover for the value of the labor and materials you furnished to the project on a mechanic's lien claim.

But can I demand more than what I am owed due to falling back on personal Bill's caused by his actions .

You are not likely to recover damages in a lawsuit for falling behind on bills unless your contract allows such damages. But you can demand more than what you are owed if you think it will create leverage to get paid. You may be able to recover interest on what is owed at 10% from the date the payment came due. Feel free to email a copy of your contract if you want me to take a look.
