Most public works projects are prevailing wage projects, but there are some projects where public entities take the position that it is not the kind of project that is subject to prevailing wage laws. The problem is that, if you go along with the representation by the public entity that the project is not prevailing wage, but it ends up that this assessment was incorrect, you are potentially exposed to fines and penalties.
