If I am a subcontractor and signed contract with. contractor for biwk payday. can he just change is that a breach ctr

TexasConstruction Contract

I am not getting payed for work performed until contractor gets payed but we signed a contract of getting payed every other week they are like 3 months behind but I also signed a non compete form so when he changed the way we got payed did he void the contract being he changed the way it was set up ?

The legal analysis would start with a review of your contract, and then extend to any communications which have occurred.

You should consider preparing a letter to mail by certified mail, return receipt requested, to the contractor to set out the facts and to demand the relief that you want. Make sure that your letter is professional and business like as it may be evidence later.

If need be, consider filing suit in small claims court (assuming that your claim is less than $20,000), using your letter as evidence.

Hello,

Lien the property you are working on. Skip the BS with the GC and file a lien against the real property using the lien process for subcontractors (Levelset can help). Once the GC knows that the property is about to get a lien against it, either he will come around or the property owner will be able to pay you with money they withhold from the GC. Generally, this works. Not 100%, obviously. But you need to go around the GC.
