The deadline to enforce a New Jersey mechanics lien is one year from the last date of furnishing labor or materials to the project. This is a hard deadline. An action to enforce your claim must be initiated within this timeframe, or the lien will expire and no longer be enforceable. The state of New Jersey does not provide a mechanism to extend the deadline or "renew" the lien. One last option before filing the lawsuit is to send a Notice of Intent to Foreclose. This isn't a required notice in NJ, but can be used as one final attempt to collect payment before you proceed with the lawsuit. If that doesn't work, you should contact a local construction attorney to guide you through the process. We have a few New Jersey attorneys in our Expert Center that you can reach out to personally.
