I signed a final waiver of lien before the owner gave me a check . The owner didnt pay . Can I still file a lien

I am a small contractor working directly for an owner . I sent him an invoice for the work we did . He demanded a final waiver of lien before he would write me a check . He never gave me a check . What can I do ? Thanks . Tim Gaughrin

Tim, based upon the brief description, the remedy available to you is pursuant to the Trust Fund Statute, 770 ILCS 60/21.02 in addition to a breach of contract action.
