i sent a retraction letter instead of a lien release. i never filed suit in 90 days. do i need to file a lien release?

I filed a mechanics lien on a job that didn't want to pay me. I then was not aware i needed to file suit and never did file suit. It seems that the lien has been expired. i am now being sued to get the lien released which i thought i already did. i am also being sued for the lawyer costs the homeowner has incurred. do i need to file a new lien release or since it has expired do i need to do anything at all?

You need to record a release of mechanic's lien. If you fail to do so, you may be found liable for maintaining a void lien, and pay the attorney's fees to obtain the order removing the lien.
