I missed my preliminary notice deadline. we are still on site. what are my rights?

If you served a 20 prelim today, it would reach back and capture your labor and materials for the last 20 days, and all labor and material ahead in time. So, depending on the amount of work recently performed, that is, in the last 20 days, and the labor and material yet to be incurred, it may make sense to serve one now.

As for anything not caputred by the 20 day prelim., you have no lien rights with respect to that material and labor, but you still have contract rights, if you are not paid for your work. Good luck.
