I’m a property owner and need to speak to a contracting attorney

LouisianaConstruction Contract

A contractor called dry out restoration sent a demo company to demo my home and they split boards throughout my home in the structure and is still requesting payment I have pictures of the damage which they said they would pay then the owner said no

Depending on the amount of damage, it would seem that you may need to write a demand letter detailing all of the issues. Ultimately, if it cannot be resolved, you may have to proceed with a lawsuit if the damage is significant enough to justify the cost of doing so. The contract may provide for attorney's fees, which would greatly assist with your cause if you do need to file suit. Give me a call if you have additional questions 504-323-5885.

Hi mr mark thanks fir the feedback when I tried to resolve the issue with mr bob who is the dry out restoration ceo of the company he threatened to put a lien on my home if he didn’t get his 17,000 dollars which I paid 6,000 dollars to him already for the demo job and water restoration and mold . I told him boards was split he didn’t care I’m scared of losing my home I’m in lake Charles la. And he’s in Florida

There isn’t much you can do regarding the placement of the lien. However, you can always fight the lien if you feel it is unjustified at the time the contractor attempts to enforce it. If the contractor places the lien you can demand that it be removed. If the contractor does not remove the lien and the court finds it should not have been placed, they may owe you attorney fees and other damages.

If he enforced the lien (this involves going to court and winning) and you refused to pay, he could try to force a sale in theory. However, there are many steps before that would happen.

Thank you so much mr mark you helped me understand better but it’s so unfair that I have to pay them all of their money and I had to pay for boards and contracting work for their mess up on my home I asked them to come and fix the problem they said they have no one to return to Louisiana to do so I’m hurt and disappointed that I have to pay all of it can u help me fight this I have pictures of the damages

If they did substandard work and caused damage, you should deduct the amount it will take to fix the issues from the amount owed. I would suggest having another contractor give you an estimate for this. The only issue is legal fees exceeding the amount of the dispute if you aren’t careful with regard to obtaining representation.

Good afternoon! We own a condo in Baton Rouge. The condo association decided to make a claim and replace the roof, finally. We paid the condo association for that. In the spring, the roofer must have had an extremely sloppy crew, who dropped a large piece of plywood from over 30 feet in the air on my ac unit. Also, he placed a nail in the freon line feeding the air handler. I am now out over 10k with all the cost of replacing the whole system - outdoor unit deemed not repairable, and air handler also had a leak. My system was still under warranty, but my ac guy said that kind of damage is not under warranty. The roofer was cooperative at first, but then became non cooperative. I am making a claim with the BBB - any additional advice is appreciated.
