A filed Alabama mechanics lien is only valid for a period of 6 months after the last day the claimant provided labor or materials to the project. An enforcement lawsuit must be initiated within that time frame, or the claim expires and is no longer enforceable. It seems as though the time to enforce an AL lien filed in September of last year has passed. If the time to enforce the claim has passed, your legal options for recovering payment will be limited to claims such as breach of contract or unjust enrichment against your customer. Few notes regarding lien foreclosure actions: This is a full lawsuit, and you should consult with a local construction attorney to guide you through the process and court filings. Unfortunately, Levelset is not a law firm and cannot represent you in a court proceeding. We do have a some Alabama-based construction attorneys in our Expert Center community which would be a good place to start your search for representation.
