For California mechanics liens, upon the date of recording, the claim will only be valid for a period of 90 days unless an enforcement action is filed. Enforcing a mechanics lien is typically unnecessary, but if the property owner continues to be uncooperative, then an enforcement action may be warranted. Note, that an enforcement action is a lawsuit, so you should consult with a local attorney if a lawsuit is necessary. We have a few California-based construction attorneys in our Levelset Community that you may want to reach out to personally to advise you on the specifics. There is one more optional step you can take to try and induce payment before filing a lawsuit. You can send a Notice of Intent to Foreclose to the owner. Consider it one last warning shot, stating that they have one more opportunity to pay before you bring the dispute to the courts.
