I filed a lien a few days before the notice was sent

My company did tree removals for a customer we agreed we would bill his insurance which we did then he got the check gave excuses and never paid us $10,400 so we filed a lien then levelset told us we need to do the notice commencement so we did that a few days late. He got a attorney and is trying to sue us for improper lien file? Do we have two years to file a lien against him again?

I’m not sure what basis the owner would have to argue the notice was served on the owner late. But if it’s a problem, you can file a mechanic’s lien in Iowa up to 2 years and 90 days after the last day on which work was completed. If you file the lien more than 90 days after work was completed, you have to provide the owner notice of the lien filing the same as if you were serving a lawsuit. You can hire a process server, have the sheriff do it (both of which probably charge a fee) or you can do it yourself by hand delivering the documents to the owner or an adult who resides in the owner’s home (e.g., spouse or adult child).
