I am a General Contractor and I have been threatened with a lawsuit

I completed work for a commercial property owner. We have 80% of work completed, and payment request was made to continue work. He requested a contrator change, and we agreed with payment made.. We have discrepancy with balance owed and he is agreeing to pay half. Email communication with coordinator on October 01,2019 for change order request as per city requirements we added materials to work and balance statements of payments made. Request for payment was made via email and mail service. The threat was placed September 01, 2020. What are my options for getting paid for work completed.

You don't say why the owner is threatening a lawsuit. Did you file a lien? Do they have a problem with the quality of the work? In other words, what's the issue, besides your claim the owner has not paid? It sounds like you are headed to a lawsuit and need to consult an attorney on the best way to proceed from here.

In some respect it probably depends on the terms of your contract. Did you place a lien on the property? You should consult with an attorney to determine what rights you do have based on the lack of payment. Feel free to reply with more information.

We did not complete perliminary notice in beginning and change order was required as per state requirement for soundproofing. Property owner not agreeing to requirement after 2 balance statements were made with mentioned total.

It does sound like you may not have a lien right then. You should definitely consult with an attorney to determine what rights you do have and how to enforce them.
