I am a GC who has to put a lien on a property in NC. Can the owner then subdivide the land after a lien is in place.

North CarolinaCollectionsMechanics Lien

We did work for a land developer who also owns a parcel of land in NC which will be subdivided. We provided acreage seeding and erosion control on the job. We have not been paid in 90 days and have filed a lien on the physical, improved property. Can the owner/developer subdivide the single parcel into multiple parcels with a lien on the single parcel. 2. If they can reparcel it into say 30 lots can they sell any of them with the prior lien put on the land when it was 1 single parcel resolved. Where does my prior lien have to be satisfied before they can sell a house on a specific parcel. Filing a $35k lien on a single large parcel makes sense but if they can parcel it into 30 lots (while still in their ownership) and my lien is no longer valid then filing new liens past 120 days out on 30 parcels at $1,667 each isn't cost effective since (or valid due to the timing).

If just getting paid what's owed you is what you want, I would be interested in giving you a free quote on how inexpensive it would be and it would be on a contingency bases, so you don't pay anything unless we collect. Send email to srauch@rauchmilliken.com Best regards, Steve
