How/when do I start the Lien to Foreclose on a homeowner?

We are company that completes work for homeowners that have suffered damage from storms and are paid with insurance proceeds or out of pocket from the homeowners. I have placed some liens on properties for failure to pay and I need to some questions answered regarding the Lien to Foreclose process..

You need to make sure that your liens are properly drafted and recorded and any required notices have been sent. Do you have a direct contract with the owner? The next step is to file a complaint to enforce the claim for lien.

Based upon your question, the liens have been recorded. Assuming they have been properly recorded, then Mr. Levine is correct, the next step, absent resolution of the issue with the property owner, would be to file suit. You must make certain of the time frame, as suit must be filed no later than 2 years after the work was completed. I would suggest you contact an attorney to discuss the details and make certain your interests are being protected.
