how long do i have to file a lien, from my last day on job. i did not file a pre-lien. thanks jeff wallace

hello i,am in utah, do i have 180 days from the last day on job to file a lien. my last day was 12/26/20. been chasing my money ever since, not looking good for payment. i,am a sub-contractor, a licenced plumbing contractor in the state of utah. thanks jeff wallace my e-mail : jeffwallace073051@gmail.com

Unfortunately, under Utah's lien laws a preliminary notice within 20 days of first furnishing labor and/or materials is a prerequisite to filing a mechanics lien. Late notice is still effective, but it will only cover the value of labor and/or materials provided in the 5 days preceding the filing of the notice, and everything thereafter. However, it appears that this time has passed.

If lien rights aren't available, there are still other options for recovery such as breach of contract claims or claims under Utah's prompt payment laws

Lastly, to answer your other question, the deadline to file a Utah mechanics lien is 180 days from the completion of the porject as a whole. Unless a Notice of Completion was filed; in which case, the deadline is 90 days from when the Notice was recorded.
