If we are in Georgia and the project is located in Mississippi, but may need to file an affidavit of nonpayment, how do we process this? I cannot travel to Mississippi to file on our behalf with the County Clerk that the project is located in. I just want to be prepared if we have to move forward on this one in the timeframe. Or when it is out of state, I need to follow Mississippi lien laws?
Lien laws are different in every state and the lien law of Mississippi would apply. You should seek counsel regarding Mississippi lien law instead of Georgia.
