How do we know if that lien is dead and we can discard lien notice from 2007.

New YorkLien DeadlinesMechanics Lien

Contractor filed mechanics lien on our property in Nassau county NY in 2007. We never received any notice from contractors or his attorney thereafter. To our understanding liens in NY expires within 90 days unless followed by a law suit.

Greetings. It appears you are a homeowner who had a lien put on your home. In New York, mechanic's liens are good for one year unless extended. Homeowners would have received notice of any extensions, especially single family home owners, whose homes can only be attached by an extended lien through court order. Once a lien is expired, it is deemed a nullity by operation of law; the homeowner needs to do nothing more. An expired lien however may continue to show up on title reports; in New York, the real estate industry is sufficiently sophisticated however to know that expired liens are insignificant and to ignore such liens. Please contact a good New York lawyer for further information.
