How do we go about enforcing a Mechanic's Lien we already have on a property? Our lien will expire in the next 7 days .

GeorgiaMechanics Lien

We completed a project in a residential home and the homeowner used their insurance check to buy furniture instead of paying the contractors. Our customer is the contractor and we are the subcontractor. The contractor has already filed a separate lien and is seeking to sue the homeowner to enforce his lien but that does not protect our interest. Please advise us how we should proceed.

You will need to file a lawsuit (referred to as a "lien action" in the Georgia lien statute) against your customer within 365 days from the date of filing your lien. Once a judgment is obtained against the contractor that hired you (it can be a judgment by consent), you can file an action to foreclose your lien against the property owner.
