How do I handle this?

TexasPayment Disputes

I have a dispute with a large company over paying for materials. The dispute is over the amount that is owed. The home closed and went to permanent loan in March. We have tried to work with this company to get the amount changed but have been ignored and pushed aside because we are a little guy and now they are seeking legal council because they have failed to retain their lien rights. What are my rights to get this handled or do I still owe them at all?

Whether or not you owe for the materials is dependent on whether the materials were delivered, and if you properly paid for them pursuant to the agreement, contract, invoice, etc. between you and the material supplier. Whether the supplier protected their lien rights only has a bearing on their ability to secure payment through a valid lien claim, it does not have a bearing on the validity of the underlying debt (which, if owed, can be recovered through a lawsuit for breach of contract, etc.) Communication is the first step to resolving any payment dispute. In many cases there can be crossed wires that are more easily resolved than anticipated - like a change order that isn't being considered by the billing department, or something similar. Otherwise, you are also able to enlist the assistance of counsel, either in response to or in anticipation of being sued for payment that is allegedly due.
