How do I get my good faith money back

My new construction home has cracks all over the garage floor with water coming in and the cinder blocks on the sides also have water coming in. We have not even moved in yet! We told the builder about this but he is not gonna do anything about it so we said we are not gonna buy this home and we need our 25000$ back that we put up for this home a year ago but he says he can’t give it back. Is this legal?

There are a number of issues in the situation you described above - and breach of contract claims,  construction defect claims, and other claims could certainly be on the table. And, certainly, a contractor performing extremely flawed and unsafe work could lead to serious issues for them and their license. At the same time, depending on the terms of the agreement, whether or not the $25,000 already paid can be recovered might not be so cut and dry. That'd be highly dependent on the terms of the specific contract that was signed. Ultimately, considering the amount of the dispute and seriousness of the issues described above, it'd probably be wise to consult a local Kentucky construction or real estate attorney. They'll be able to review the project documentation, documentation of the alleged defects, and relevant communications then advise on the best way to move forward.
