Gave a roofing company 3 grand down payment he was supost have already had the roof done and hasn't plus he won't give me my money back

It's going to depend on what's in your contract but you can certainly sue them for breach of contract and likely some sort of consumer protection violation. Reach out and I'll see what I can do to help.
