How do I collect the payment restitution ordered by the CA CSLB-Dept of Consumer Affairs

CaliforniaConstruction Contract

The Contractors State License Board-State of California (Case # N2013-374) disciplined Solage Landscape Exteriors (contractor Lic # 935523). The Respondent was to pay restitution to 14 parties, which I was one of them. The Decision was effective December 6, 2017. To date the Respondent has not paid me a penny.

According to the CSLB on-line records, when the contractor failed to pay the restitution payment, they suspended his contractor’s license. This can still sue the contractor for your damages if the time hasn’t run on your claim. The statute of limitations for a written contract is 4 years from the date of the breach. It’s 2 years for an oral contract. You should discuss your rights and options with an experienced construction attorney. One of the things to consider is the amount of your damages, whether or not the contractor is still around and can be located, and whether or not they have enough money to pay a judgment you may win against them.
