How do I, and or can I file a lien on a property in Az. if live in Colorado?

Arizona

My mother passed away without a will, my sister has not taken the proper steps to aquire the property. Now she's trying to sell it as is, to a neighbor to get & keep all the money. Can I file a lien to assure she splits it with me? She hasn't gone through probate or anything . Also I am not certain what type of lawyer I need.

I am sorry for your loss. If your mother passed in Arizona then this is an Arizona probate matter. You should contact an Arizona probate attorney to discuss petitions, an accounting, and other steps your attorney can take in probate court to protect your interest. 

To your question, no you cannot file a lien under your facts. A lien is only allowed for parties who improve real property. File a lien and expect a quick action to have it removed and for you to be liable for attorney fees and costs. 

I practice in both Arizona and Colorado and also provide probate law services. I am dealing with several contested probate matters now. Again, do not consider filing a lien. You need a probate attorney and they can consider actions for appointment and other steps.
