I gave someone I lived with $38,000.00 to help pay for work being done to home, he died a month ago. His brother is executor of his estate and now taking over the house. Can I file a Mechanics Lien?

Mechanics lien rights are meant to protect those who actually performed work or supplied equipment or materials to a construction project. Michigan mechanics lien rights in particular, are only available to contractors, subcontractors, suppliers, or laborers who provided an improvement to the property. Thus, a mechanics lien would not be the appropriate remedy in this situation. However, you may want to consider filing a claim against the estate of the deceased (depending on the type of estate). This would require going down to the appropriate probate court, identifying the case number, and filing a claim. There are specific deadlines and requirements that must be met in order to properly file a claim against the estate. I'd recommend contacting a local attorney to help guide you through the process.
