Hello!

I need some more facts. Did you sign a contract with the owner or did you sign a contract with a general contractor?

If you signed a contract with the owner, the next step is to file an affidavit claiming lien with the county in which the property is located.

If you signed a contract with a general contractor, you need to hurry up and get pre lien notices out as fast as possible. You're on a clock and may have missed deadline one but you should not miss the others. Once notice has gone out, you should file the affidavit claiming lien with the county in which the property is located.

Keep in mind that a lien is nothing more than a notice claiming an interest in the property. To enforce the lien, you will need to sue in District Court. This would wake everyone up and you should see more movement on the project.

If you would like help with this, please give me a call.

Prior to filing suit against the company for non payment, you could let a commercial collection agency member of Commercial Collection Agencies of America CCAofA attempt to collect the debt on a contingency fee bases so you aren't throwing good money after a bad debt. If for any reason they can't collect you will owe nothing and can still file suit then. Feel free to email srauch@rauchmilliken.com for a free referral or quote. Best regards, Steve
