How can I get a property liened in Florida for $13,168 (US) owed to me . I live in Canada and I am senior.

I am owed money from a person who owns a property in Florida and I want to lien the property. I have signed documents from him that he will pay me however, I heard he will probably put the house on sale . I want to make sure that I get paid for my money. Can I download the paper work for owed amount of $13,168 US . I live in Canada and I am senior . Any help would be greatly appreciated. Dorothy - dgraham8302@hotmail.com

Dorothy, a construction lien is only available for improvements made to a property by a contractor. For you circumstances, you would probably need to hire an attorney to file suit and then obtain a judgment lien in order to have a lien against the property.

Thanks so much for answering me. Could you please tell me how much this would cost if I hired a lawyer & how long it would take to lien the house. Is this the only way that I can do this? Thanks

It really depends on why / how you're owed the money. At a minimum, it would likely take 6 months to a year to obtain the judgment. You can check out the Florida Bar website (www.floridabar.org) to find an attorney near where the property is located. Or feel free to call me at 813-225-3057. I may not be able to help you directly, but I can at least point you in the right direction.

While you have the right to file suit and obtain a judgment, in lieu of being sued by you the debtor might be willing to give you a mortgage on the property. This would insure that you would be paid if the property were sold.
