How can a pool contractor that acted outside of his classification put a lien on my home The CSLB already did their investigation and there is now an accusation filed against the contractor. The contractor is still suing us to foreclose on our home despite the independent contractor’s report stating damages in the amount of $70,000

Did the contractor actually file a lawsuit to foreclose upon the lien?  If so, you should retain your own attorney to determine your options here. --CN

Yes, he filed a lawsuit to foreclose. I do have an attorney, I was interested in hearing another opinion. No written contract, no change order, deposit $13,000, no permits or inspections, went outside of his classification.

The CSLB investigation has nothing to do with the lien claimant's rights. The county recorder does not police lien filings. If the pool contractor truly performed all of the work out of class, he may be unlicensed and not entitled to payment or recordation of a lien. That would have to be determined in the lawsuit.
