Your question is very unclear. What damage? Have you had the roof inspected by a roofer? That would be your first step. Find out how the roof was damaged. If it was damaged by wind, you *might* have an insurance claim. But if the roof is simply leaking, and it's a 30 year old roof, then no, you don't have a defective construction claim on the original roof. The statute of repose is either 15 or 10 years (the statute changed about 10 years ago) from the date the house was built and you are well outside either time frame. If it is not the original roof, then it would depend on the age of the roof, not the age of the house.
