Does a contractor need a signed agreement with property owner in order to file a mechanics lien?

A contractor can record a mechanic’s lien without a signed agreement but they can get into trouble with the Contractors State License Board if they were required to have a written signed agreement and didn’t. The CSLB requires any contractor who’s dealing directly with a homeowner on a remodel project to have a signed written agreement. If the homeowner files a complaint with the CSLB against the contractor, and the CSLB finds that the contractor didn’t have a signed written agreement with the homeowner, the CSLB can fine the contractor, or even suspend or revoke their license.
