Does a contractor need a signed agreement with property owner in order to file a mechanics lien?

A contractor can record a mechanic’s lien without a signed agreement but they can get into trouble with the Contractors State License Board if they were required to have a written signed agreement and didn’t. The CSLB requires any contractor who’s dealing directly with a homeowner on a remodel project to have a signed written agreement. If the homeowner files a complaint with the CSLB against the contractor, and the CSLB finds that the contractor didn’t have a signed written agreement with the homeowner, the CSLB can fine the contractor, or even suspend or revoke their license. However, the lien will still remain on the property. I’m happy to answer any questions you have about this.
