foreclosure deadline.Can I enforce the lien to get paid

I did a project at the pendry hotel.I was not paid for the project.I put a lien on project I get no return calls

Illinois law grants contractors who improve proerty a Mechanics Lien by law. No Notice of Lien needs to be recorded. However, merely having, or even filing notice of, a lien claim does not result in payment. Under the terms of the Illinois Mechanics Lien Act, you must take 3 steps to get paid:

  1. Deliver (Record) notice of lien within time limits;
  2. Perfect your lien within those the time limits; and
  3. Enforce your lien in the Courts within 2 years.

While your lien may be paid at any time, even before completing these steps, you must comply with the law and proceed with all steps, or risk losing your lien rights.

Yes, assuming your lien was properly perfected, you can file a lawsuit to foreclose based upon the lien. Generally, you have 2 years from the date you last performed work to commence a lawsuit to enforce the lien. Failure to file within said time period will forfeit the lien.

You may have to file suit to enforce your lien. Call an attorney who practices lien law.
